NEXUS ARC END USER LICENSE AGREEMENT Last updated: September 7, 2026 This End User License Agreement ("Agreement") is a legal agreement between you and Federico Guerra, an individual based in Italy publishing as BlackSmith_Forge, for the Nexus Arc software application, including the installer, executable files, bundled components, documentation, updates, and related materials (collectively, the "Software"). By installing, copying, launching, or using the Software, you confirm that you have read, understood, and accepted this Agreement. If you do not agree, do not install or use the Software. 1. Ownership and Copyright The Software is licensed, not sold. Federico Guerra and his licensors retain all ownership, copyright, intellectual property, trade secret, and other proprietary rights in and to the Software. Copyright (C) 2026 Federico Guerra. All rights reserved. No rights are granted except as expressly stated in this Agreement. 2. License Grant Subject to your compliance with this Agreement, Federico Guerra grants you a limited, revocable, non-exclusive, non-transferable license to install and use one copy of the Software for personal or internal business use on devices that you own or control. 3. Permitted Use You may use the Software to scan, preview, organize, group, and import media from supported iPhone devices to folders selected by you. You may keep a reasonable backup copy of the installer solely for your own reinstallation or recovery needs. You are responsible for maintaining independent backups of your media and for verifying imported results before deleting or modifying original files on any device. 4. Prohibited Use You may not copy, redistribute, sell, rent, lease, sublicense, host, publish, share, or otherwise provide the Software to any third party without prior written permission from Federico Guerra. You may not modify, adapt, translate, decompile, disassemble, reverse engineer, attempt to derive the source code of, bypass update or integrity mechanisms in, or remove proprietary notices from the Software, except to the extent such restriction is prohibited by applicable law. You may not use the Software to violate third-party rights, applicable law, platform rules, or device access restrictions, or in high-risk environments where failure could cause personal injury or loss of data that is not independently backed up. 5. Third-Party Components The Software may include third-party libraries, runtimes, codecs, drivers, tools, or other components. Those components remain subject to their own license terms. Nothing in this Agreement limits any rights you may have under applicable open-source or third-party licenses, including the right to replace or modify a component where its license provides that right. Third-party notices, license texts, and source availability information are included in the Legal directory distributed with the Software. They apply only to the identified components and not to proprietary Nexus Arc source code. 6. Privacy and Local Data The Software is designed to process media locally on your computer and to store operational data in the application's per-user local data area. Nexus may create local logs, scan reports, import manifests, diagnostic files, settings, preview caches, and similar operational records to help you review imports and troubleshoot issues. The Software does not intentionally upload your media files to Federico Guerra. You control any files, screenshots, logs, or diagnostics that you choose to share for support. 7. Updates Federico Guerra may distribute updates, fixes, compatibility improvements, or new versions through the Microsoft Store at its discretion. Installation and automatic update behavior are governed by the user's Microsoft Store and Windows settings. Updates may modify features, file handling, supported formats, user interface behavior, or compatibility with devices and operating systems. You remain responsible for maintaining appropriate backups before using the Software. 8. No Warranty The Software is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, Federico Guerra disclaims all warranties, whether express, implied, statutory, or otherwise, including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, error-free operation, and compatibility with every device, cable, driver, operating system, or media format. 9. Limitation of Liability To the maximum extent permitted by law, Federico Guerra will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, media, profits, revenue, goodwill, business interruption, device access, or computer operation, even if Federico Guerra has been advised of the possibility of such damages. Federico Guerra's total liability for any claim related to the Software will not exceed the amount you paid for the Software during the twelve months before the claim arose, or EUR 10 if you obtained the Software without charge. Nothing in this Agreement excludes liability that cannot be excluded under applicable law. 10. User Responsibility You are responsible for using suitable and certified cables, keeping your iPhone unlocked and trusted when required, maintaining sufficient device and computer power, choosing correct destination folders, reviewing logs where appropriate, and verifying imported files. The Software must not be treated as the only backup or only copy of important media. 11. Termination This Agreement remains effective until terminated. Your rights under this Agreement terminate automatically if you breach its terms. Upon termination, you must stop using the Software and uninstall it. Sections that by their nature should survive termination will survive, including ownership, prohibited use, third-party components, privacy, warranty disclaimer, limitation of liability, governing law, and contacts. 12. Governing Law This Agreement is governed by the laws of Italy, without regard to conflict-of-law principles. Any dispute relating to this Agreement or the Software will be handled by the competent courts under applicable Italian law, unless mandatory consumer protection rules provide otherwise. 13.
